Commercial law or commercial law is , in broad terms, the branch of law that regulates the exercise of trade for the various economic operators in the market. The progressive internationalization of business and the need for public authorities to establish a framework for consumer protection and maintaining economic and financial stability has been giving rise to what is known as the phenomenon of "publification" Law Mercantil, namely that are becoming more and more rules of public law which are intermingled with purely private law rules to safeguard those interests. Notable example is all the rules of supervision and punishment on the financial system, where all operative societies in it and operations performed therein are heavily guarded.
In most laws , laws and decrees , a relationship is considered commercial , and therefore subject to commercial law , if an act of commerce . The current commercial law refers to these acts , of which they are intrinsically , although in many cases the person who performs does not have the quality of trader ( target system ) ; This notwithstanding , there are legal systems in which the system is subjective , based on the company by regulating both their legal status, as the exercise of economic activity , in its contractual relationships that keep entrepreneurs among themselves and with third parties.
In other legal systems exist, especially in the common law , not a unified view of "Business Law" (nor do other branches of law ) , but the object of his study is divided between small legal fields ( such as Companies " Law , Corporate Law and Antitrust Law ) that have no unified basis as other sources occurs in continental legal systems where there is usually a Commercial Code which serves as a cornerstone to the entire system .
